These terms apply to your use of ripmachines.com and to purchases from RipMachines vending machines. By using the website or buying from a machine, you agree to them. If you don't agree, please don't use the website or machines.
Using the website
You may use this website for lawful, personal and business purposes. Don't misuse it, including by trying to break its security, overload it, scrape it in bulk or submit false information through its forms.
Purchases from our machines
- Prices are shown on the machine before you pay and include any applicable taxes unless the machine says otherwise.
- All sales are final once a product has been successfully dispensed.
- If you are charged and a product does not dispense, or the wrong product dispenses, email hello@ripmachines.com within 7 days with the machine location, date, time and last four digits of your card. After we confirm the issue, we will refund the charge or replace the product.
- If you are under 18, please buy only with a parent or guardian's permission.
Random contents and card values
Trading card packs, boxes and mystery products contain randomly assorted cards. No specific card, player, character, grade, rarity or value is guaranteed in any purchase. Any "hits" or chase cards shown on a machine or online are examples of what may be found, not a promise of what you will receive.
Card values change over time and vary by marketplace. We do not guarantee the current or future value of any product, and we do not buy back products. Grades on graded cards are assigned by independent grading companies, not by RipMachines.
Host applications
Submitting a host application does not create an agreement or commit either of us to placing a machine. Any placement, revenue share or service arrangement will be set out in a separate written agreement signed by both parties.
Partner applications
Submitting a distribution partner application does not create an agreement or commit RipMachines to buy, stock or sell any product. Any purchase, consignment or supply arrangement will be set out in a separate written agreement or purchase order. Partners must supply only authentic product they have the right to sell.
Intellectual property
The RipMachines name, logo, website design and content belong to RipMachines and may not be used without permission. Pokémon is a trademark of Nintendo, Creatures Inc. and GAME FREAK inc. Sports league, team and player names and logos belong to their respective owners. RipMachines is an independent business and is not affiliated with, sponsored by or endorsed by any of them. Third-party products are sold as genuine, sealed merchandise.
Disclaimers
The website and machines are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We don't guarantee the website or any machine will always be available or error-free.
Limitation of liability
To the fullest extent the law allows, RipMachines will not be liable for indirect, incidental, special or consequential damages arising from your use of the website or machines. Our total liability for any claim related to a purchase is limited to the amount you paid for that purchase. Nothing in these terms limits any rights you have under California law that cannot be waived.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in California, unless the law requires otherwise.
Changes
We may update these terms from time to time. When we do, we'll change the date at the top of this page. Continuing to use the website or machines after a change means you accept the updated terms.
